I have left the card in the box switched on BBC1 for 2 weeks.
I have tried other FTV and subscription cards in the box (Pana) which
work OK.
I have also left the card in another box (Amstrad) for a week and it
still did not get 'the signal'.

This is probably where you went wrong. Once you have requested
activation you MUST leave the card in the right box without removing
it or switching the box off until the card is activated. Putting the
card in the wrong box is guaranteed to prevent activation.

Stick it in and leave it alone.

Err how long for ?

Is 3 weeks long enough ? only then did I try other things !

BTW the other two cards I ordered both worked immediately (not even in
the correct boxes)

Colin.

It did when BSkyB ran the FTV card service!, but when the contract was
moved to BT Contract Services, modem initialisation wasn't part of their
original contract with the BBC. So it didn't work!.

It did with both of my boxes.

It worked fine, once it got altered - but for the first few months after
BT Contract Services took over it wasn't possible.

How many times did you request activation during that time?

They were replacement cards. These come pre-activated.

The sixth time they asked me to reset the box (never mind that I told
them that I already done the reset).

From what you describe the card is simply faulty. I have always found
them to be very quick to send out replacements for faulty cards.

And when I asked how could I have my money back they told me that the
card is non-refundable...

This is nonsense of course and quite illegal to boot under the
distance selling regulations and other UK legislation.

This is incorrect & would actually be illegal for them to refuse a refund if you
return the card to them. Just mention the Sale & Goods Act & being fit for
purpose.

They will probably tell you "the card remains their property at all
times", like the Sky card, so they haven't actually sold anything to
you!

They have indeed sold the service of viewing. As it has not been
provided they must refund the money.

If they can demonstrate that it *does* work, and that the fault is in
your equipment, they are not liable to issue any refund.

1) They could not demonstrate this.
2) The onus of proof is on them.
