The mandate is for over the air transmission of television, which is regulated by the FCC. The FCC does not regulate cable television or its programming, since cable television is sent out using private cable resources. The FCC deals only with public resources--the airwaves. So, since the FCC does not have, never did have, and never will have any say on what is sent over a privately owned cable, then cable TV was never theirs to exempt in the first place. To sum up: cable was never part of Congress's mandate for doing away with analog transmission and moving to digital transmission.
