The act of copying electronic data does not destroy the original - the owner is still free to sell it. There is nothing to "return" because the original is still in place. Ergo, it cannot have been "stolen", ergo it is not theft. It is an infringement of rights, nothing more. Stealing a DVD from Woolies - theft. Physical property, taken from the owner in such a way as to permanently deprive them of it. Theft. Copying a DVD - copyright infringement. No physical property has been taken, the owner still has the original. The offence in the making of an unauthorised copy. That offence is not theft. It is something else. Do you understand? -- |
