Hardly a secret

Dave scribbled a message in
. This may or may not have
been its contents:

All the moaning and groaning about the fact that the V1 cards will no
longer work and how Sky and/or ITV/Channel4/Channel5 should be
horsewhipped is getting boring.

Everyone who uses these newsgroups knew that V2 cards were being
issued and that BBC were going to withdraw from providing free cards.
Anyone without the nous to obtain a V2 card from the BBC before they
stopped issuing them has only themselves to blame.

Hence the fact I got one about two weeks ago. What about the majority of
FTV viewers, who probably don't read this newsgroup?

How's about all you guys out there with a FTV subscribe to Sky on their
Value Pack for 1 month (£12.50) then cancel? You have no 12 month commitment
when you do this as you already have the box. They will send you a V2 card,
and then 30 days later you cancel? Or am I barking up the wrong tree?

Not everyone reads the newsgroups. In fact I suspect that the vast
majority of FTV viewers are totally unaware that the BBC has gone FTA
or that new cards may be needed.

There is also some suggestion that series 2 cards may not continue to
work until the next release.

I personally had all my 4 FTV cards replaced over the last few weeks
and I have been collecting expired series 2 subscription cards for
some time, just in case.
I am however concerned for those who were not aware that this might be
a good idea.

New subs carry a 12 month minimum (in fact a 13 month minimum as Sky
won't accept cancellation notices until the end of the first year,
though this could easily be disputed in court). Only people
re-activating an existing sub can cancel after one month.

You don't have to pay for a 13th month. I wrote and gave them a month's
notice to quit with effect from the end of the minimum term, as per the
contract, and it all went through without a hitch.

You were lucky, or perhaps Sky have finally realised that what they
were doing was unfair and unenforceable. I suspect the former.

Good heavens, it never even crossed my mind at the time that the minimum
contract could be made into a 13 month one because Sky would refuse to
accept my notice in time to terminate at the end of the 12 months. Phew.

Looking at the contract again, I can see how it might conceivably, although
mistakenly and unlawfully I have no doubt whatsoever, be taken that way
when it says 'If you want to end the contract after the end of the minimum
term for any reason, just give us one calendar month's notice'. If they'd
said that to me, I would certainly have complained and cancelled my direct
debit anyway, and I'd like to have seen them try to get another month's
money out of me. How on earth could they possibly think a minimum term
could be forcibly extended when you have in your possession a signed
contract for the minimum term? Lunatics.

It's perfectly simple. You agree to give them a month's notice, but you can
still cancel by 12 months, so you phone up after 11 months. It's not exactly a
brain-teaser is it?

And if you'd cancelled the DD after 12 months while cancelling then, thus
owing them one more month that they couldn't collect then you'd be in big trub
and owing to debt collectors.

They rely (relied) on the fact that they had the upper hand and that
most people don't argue.
