If so, it's still covered by part of the manufacturer's warranty - the "parts" part of the warranty is still in force, although the 90-day "labor" part has expired. You can have it repaired for the cost of shipping and labor, and your lifetime service policy *WILL* be retained on the repaired (or exchanged) unit. As to the failure itself - yes, it's most unfortunate. With any product as complex as a TiVo, there are bound to be a few units which fail during their first year or two of operation. Most such devices exhibit a "bathtub" failure curve - some units fail quite soon after they're first installed ("infant mortality"), then the failure rate drops off to a very low level for several years, and then the failure rate gradually increases as components start to wear out. It sounds as if your TiVo is one of the relatively few which failed after the "infant mortality" period, but rather sooner than the "wear-out" point (which should be quite a few years). This might indicate a defect in the drive, or might indicate that the drive was damaged during shipping or in use. Like desktop-style personal computers, a TiVo system really shouldn't be banged, dropped, or moved around with the hard drive spinning... this can "slap the heads" in the drive and cause physical damage to the mechanism. I do not recommend that you throw your TiVo system away, or sell it for a nominal fee. If you are truly dissatisfied with it, you could reclaim most of your investment in it by having it repaired by TiVo, and then selling it as an intact, working unit with lifetime service (the lifetime service is fully transferrable to a new owner). Before you do this, though, I'd suggest that you go spend some time researching the experiences of people who have spent a few months, or a year or more using the competing products on the market - i.e. the non-TiVo DVRs which are being offered by satellite and cable companies. You were given a multitude of options which would likely have resolved your issue to your complete satisfaction yet instead you come into a group that contains fans of the product (go figure with a name like alt.video.ptv.tivo) and expect any less? Do you go into the Xbox groups and say PS2 rulez and Xflop blows and expect to be greeted warmly? Well, I assure you, that is indeed the case. And you have been assured it isn't. I would bet secretly you have already resolved the issue and are happily using your Tivo as you type yet you aren't man/woman enough to admit you were a bit hasty in your judgment.
